Tornado Cash defense claims prosecutor misled court on legal issues involving crypto mixers

Odaily Planet Daily News: Roman Storm, co-founder of Tornado Cash, has been accused by defense lawyers of misleading the court by US federal prosecutors on the legal application of non custodial cryptocurrency mixers, claiming that prosecutors did not disclose key communications with the Financial Crimes Enforcement Network (FinCEN), which could weaken the government's core allegations that Tornado Cash operates as an unlicensed fund transfer business. The defense of Roman Storm cited details disclosed in a case related to the developer of Samourai Wallet, emphasizing that FinCEN had previously stated that Samourai Wallet may not meet the definition of a fund service business due to not hosting user funds. Given that Tornado Cash is also a non custodial agreement, the defense argues that this position also applies. Currently, Roman Storm's legal team is requesting the court to require the government to disclose all communications with FinCEN and provide materials related to the Samourai Wallet case. The trial is expected to begin on July 14th. (DL News)
